Southview Design Construction, Inc. Ugly Yard Contest Official Rules 1. Rules These rules are the rules for the Southview Design Construction, Inc. Ugly Yard Contest (“Rules”). No purchase is necessary. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited or restricted by law. All Federal, state and local regulations apply. Ugly Yard Contest (“Contest”) is sponsored by Southview Design Construction, Inc. in conjunction with its chosen subcontractors and suppliers (“Sponsors”). 2. Eligibility Contest is offered only to legal residents of the United States 21 years of age or older at the time of entry. Limit one winner per household. Limit one winner per family. Limit one winner. Prizes are not transferable by winners. Contest is only offered to Minnesota residents who reside within the greater Minneapolis-St. Paul SMSA. Employees of the Sponsors, and any affiliated companies, their promotional or advertising agencies (collectively, the “Contest Entities”), and their collective immediate family or members of the same households as such individual are not eligible. No groups, clubs, businesses or organizations may participate in this Contest, or reproduce or distribute any portion of these Rules to their members or personnel. Proof of age, identity, and eligibility must be furnished to the Sponsors upon request. All entry information must be complete and accurate. Sponsors will not award a prize to anyone not meeting eligibility requirements at the time of entry. Sponsors reserve the right to disqualify any entrant if these Contest Rules are not followed. By entering, you agree to comply with all applicable laws and these Contest Rules and you agree to abide by all of the decisions of the Sponsors. Only owner-occupied, single-family residences are eligible. 3. Entry Period The Contest entry period begins July 26, 2008 and ends at 4:00 p.m. CDT on May 1, 2009. All entries must be submitted via the online entry form. Any entry form submitted by facsimile or otherwise will be void. All entries must be received by 4:00 p.m. CDT on May 1, 2009. Sponsors will not verify receipt of entries. Entries become the property of Sponsors and will not be returned. Sponsors are not responsible for entries that are lost, late, misdirected, incomplete, incomprehensible, illegible, damaged, undeliverable or delayed. Photocopied and mechanically generated entries are void. Entries generated by automated means are void. 4. Selection of Winner The Sponsors will assess the entry forms together beginning on May 2, 2009, and determine the winner. The winner will be notified by phone or e-mail, at the convenience of the Sponsors. Sponsors are not responsible for incomplete, incomprehensible, illegible or out-of-service contact information. If Sponsors are unable, after making a reasonable effort, to contact the winner, that winner will be disqualified and a new winner will be selected. 5. Prize Description A gift certificate worth $5,000 of landscape design and construction services from Southview Design will be awarded. The $5,000 gift certificate may be used for design & planning services, construction services, and installed plant material, hardscaping, and other landscaping materials. The gift certificate may not be used for subcontracted services including, but not limited to, decks, fences, and swimming pools. Designs and plans remain the property of Southview Design. Designs and plans are not the property of the homeowner/winner, until the project has been installed by Southview Design. There shall be no cash equivalent awarded. All fees, charges, and costs not specifically included in the prize description above, including, but not limited to, personal incidental items, transportation, taxes, souvenirs, tips, and licenses, are the responsibility of the winner. Sponsors reserve the right to substitute prizes of equal or greater value. The gift certificate must be presented for redemption within 60 days of receipt. If the winner does not redeem the certificate within 60 days of receipt, the winner shall be disqualified and a new winner shall be selected. 6. Odds of Winning Odds of winning depend on the number of eligible entries received. 7. Terms and Conditions Participants are responsible for complying with all applicable federal, state and local laws and regulations and with these Contest Rules; and by entering, participants agree to be bound to these Contest Rules. Any security breach or other attempt by an entrant or other party to tamper with the proper administration of the Contest shall disqualify the entrant and may result in civil or criminal action against the entrant or other party, and may result in discontinuation, suspension or cancellation of the Contest. Winners and entrants agree, except where prohibited by law, to release and discharge, hold harmless and indemnify the Contest Entities, their employees, agents, representatives, officers and directors and their immediate family members, successors and assigns, and all others associated with the development and execution of this Contest, from any and all tax liability that may be imposed or associated with receipt of these prizes, and from and against any and all claims, actions, proceedings, and liability for any damages, expenses, fees, injury or losses (INCLUDING PERSONAL INJURY OR DEATH) sustained in connection with the receipt, ownership, or use of the prize or while traveling to, preparing for, or participating in any Contest-related or prize-related activity. By entering the Contest or by winning, participants grant to the Sponsors the right to publicize the before- and after- reproductions of the landscaping project in any and all forms, participants’ name, photograph, image, likeness, voice, statements, and biographical information for advertising, trade, and promotional purposes without compensation and without opportunity for review, except where prohibited by law. Winners must execute an affidavit of eligibility and liability and publicity release prior to receipt of any prize. Sponsors retain the discretion to make all decisions regarding the interpretation and application of these Rules. All decisions of the Sponsors are final and discretionary. In the event, the selected winner of the prize is ineligible or refuses the prize, or in the event the prize is forfeited for any other reason, the prize will be forfeited and the Sponsors will select another winner out of the remaining eligible entries. The laws of the State of Minnesota shall govern this Contest, without regard to Minnesota’s choice of law rules. The courts of Minnesota shall be the exclusive forum for any dispute resolution relating to these Rules and/or this Contest. All participants and winners agree, by their participation in this Contest, to submit to the personal jurisdiction of the courts of Minnesota. For prizes of $600 or greater, the winner must provide his or her Social Security Number for tax purposes. Prizes may be considered income, and any and all taxes associated with prizes are the responsibility of the winner. 8. Disclaimers and Force Majeure Contest Entities, their affiliated, parent and subsidiary companies, their employees, agents and officers, advertising and promotion agencies, and all others associated with the development and execution of this Contest are not responsible for: (1) problems associated with television transmission, radio transmission, cable transmission, satellite transmission, phone lines, facsimile, or cable lines and/or phone or IP numbers that are beyond their control – this includes, but is not limited to: a busy signal, operator interference, cellular interference, Internet congestion, technical or atmospheric conditions that disrupt the completion of a phone call, facsimile transmission, e-mail transmission, or cable modem service, or other Internet interruptions or malfunctions or for technical difficulties which may prohibit, prevent or interfere with the transmission of information about or in response to the Contest to all or some limited portion of the eligible geographical area of the Contest during the Contest or that may prohibit, prevent, or interfere with the submission of an entry form; (2) failures of or other problems relating to computer hardware, software, internet, or similar systems, including but not limited to difficulties relating to participants’ ISP, DSL, or cable modem access, “worms”, or viruses; (3) typographical errors in materials relating to this Contest; (4) lost, misdirected, illegible, incomplete, or delayed entry forms; (5) cancellations, postponements, or delays; (6) Acts of God, war, terrorism, government regulation, disaster, fire, strikes, civil disorder, or other similar causes beyond the control of the Contest Entities, their affiliated, parent and subsidiary corporations, advertising and promotional agencies and their immediate assigns, making it inadvisable, illegal, impossible, or impractical to continue the Contest or to perform under these Rules. Contest Entities make no warranty, guarantee, or representation of any kind concerning the prize, and the Contest Entities specifically DISCLAIM ANY IMPLIED WARRANTY OF MERCHANTABILITY, WARRANTY OF FITNESS, AND ANY OTHER IMPLIED WARRANTY. 9. Official Rules and List of Winners Official Rules, as posted at www.southviewdesign.com supersede all other published editions. Sponsors reserve the right to change, alter, or amend these Contest Rules as necessary and in their sole discretion, to ensure the fair administration of the Contest or to comply with applicable law.
